Sexual assaults are among the most serious, if not the most serious, types of charges in the American criminal justice system.  With the possible exception of homicide charges, no charges carry more negative consequences than these.  In the State of New Jersey, sexual assault occurs when the perpetrator commits any of the following acts:  a) any type of sexual penetration or act on an individual less than 13 years of age; b) any type of sexual penetration on a victim who is between the age of 13 and 16 and 1) is related to the victim by blood or affinity to the third degree, 2) the perpetrator has supervisory power over the victim, 3) the perpetrator is the guardian of the victim; c) any type of sexual penetration on any victim wherein the perpetrator possesses a weapon or object used to induce fear in the victim; d) any type of sexual penetration wherein the perpetrator uses physical force in order to coerce the victim; e) sexual penetration on a victim who is in a state of physical or mental helplessness (see full details in "NJ Sexual Assault Statute").
