Carjacking in the State of New Jersey occurs when a perpetrator a) inflicts bodily injury or uses force to gain control of an occupied motor vehicle, b) threatens an occupant or person in control of a motor vehicle or purposefully instills fear of bodily injury unto the occupant or person in control of the vehicle, c) immediately commits or threatens to commit any crime in the first or second degree in order to gain control of the vehicle, or d) operates or causes said vehicle to be operated with the person who was in possession or was an occupant remaining in the vehicle. The act of carjacking is in direct violation of N.J.S.A. 2C:15-2.
